TERMS AND CONDITIONS OF THE QUESTSPORT.SHOP ONLINE STORE

This document outlines the terms and conditions for concluding sales agreements through the Store, containing key information about the Seller, the Store, and the Consumer’s rights.

Provisions concerning Privileged Entrepreneurs apply to contracts concluded from January 1, 2021.

§ 1 DEFINITIONS

• Business Days – Monday to Friday, excluding public holidays.

• Consumer – a consumer as defined by the Civil Code.

• Account – a free function of the Store (electronic service) regulated by separate terms and conditions, allowing the Buyer to create an individual account.

• Buyer – any entity purchasing from the Store.

• Privileged Buyer – a Consumer or a Privileged Entrepreneur.

• Privileged Entrepreneur – a natural person entering into a contract with the Seller directly related to their business activity but not of a professional nature (definition applicable to contracts concluded from January 1, 2021).

• Terms and Conditions – this document.

• Store – the questsport.shop online store, operated by the Seller at https://questsport.shop.

• Seller – QUESTSPORT Sp. z o.o., headquartered at Wiejska 52B, 58-506 Jelenia Góra, registered in the National Court Register - Business Register by the District Court for Wrocław-Fabryczna, 9th Commercial Division of the National Court Register, under KRS number 0000907537, NIP 6112812746, REGON 231226060, with a share capital of 100,000.00 PLN.

§ 3 TECHNICAL REQUIREMENTS

For proper functioning of the Store, the following are required:

• A device with internet access

• A web browser supporting JavaScript and cookies

• An active email account (for placing orders)

§ 4 PURCHASES IN THE STORE

• The prices of products in the Store are total prices including all applicable taxes.

• The total order price consists of:

  • Product price

  • Shipping costs (if applicable)

• To make a purchase, the Buyer adds the selected product to the cart.

• The Buyer then selects the delivery method and payment method and provides the necessary order details.

• The order is placed upon confirmation of its content and acceptance of the Terms and Conditions.

• Placing an order constitutes a sales agreement between the Buyer and the Seller.

• The Seller provides Privileged Buyers with confirmation of the sales contract on a durable medium no later than at the time of delivery.

• The Buyer may register an account in the Store or make purchases without registration.

§ 5 PAYMENTS

Payment for an order can be made via:

• Bank transfer to the Seller’s account

• Credit/Debit Card:

  • Visa

  • Visa Electron

  • MasterCard

  • MasterCard Electronic

  • Maestro

• Online payment platforms:

  • Shoper Payments (operated by Blue Media S.A.)

• Cash on delivery (card or cash upon delivery)

• Cash/card payment upon personal pickup

• For prepaid orders, payment must be made within 1 business day from order placement.

• Some payment methods may require immediate transaction processing upon order placement.

• The Buyer accepts the use of electronic invoices by the Seller (with the option to withdraw this acceptance).

§ 6 ORDER FULFILLMENT

• The Seller is obligated to deliver products free of defects.

• The order fulfillment time is indicated in the Store.

• If the Buyer selects prepayment, order processing begins after receiving the payment.

• If multiple products with different processing times are ordered, the order will be shipped according to the longest fulfillment time.

• Shipping is available to the following countries:

  • Poland and EU countries (detailed list provided in the Store)

• Available shipping methods:

  • Courier delivery

  • InPost parcel lockers

  • Personal pickup at the company’s headquarters

§ 7 RIGHT OF WITHDRAWAL

• A Privileged Buyer has 14 days to withdraw from the contract without giving any reason.

• The withdrawal period starts from the day the Buyer or a designated third party (excluding the carrier) receives the product.

• To exercise the right of withdrawal, the Buyer must notify the Seller using the contact details provided in § 2.

• The Buyer may use the withdrawal form (Appendix 1), but it is not mandatory.

• Refunds will be issued within 14 days after the Seller receives the returned product.

• The Seller may withhold the refund until the returned product is received or proof of its return is provided.

• The Buyer covers the return shipping costs.

§ 8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply to contracts for:

• Custom-made or personalized products

• Perishable goods or those with short expiration dates

• Sealed items that cannot be returned for health or hygiene reasons once opened

• Digital content not delivered on a physical medium

§ 9 COMPLAINTS

• In case of product defects, the Buyer may submit a complaint based on statutory warranty rights.

• Complaints should be sent to the Seller’s address or email provided in § 2.

• If required, the defective product must be sent to the return address at the Seller’s expense.

• Complaints regarding Store operation should be directed to sklep@questsport.cc.

• The complaint resolution period is up to 14 days.

§ 10 PERSONAL DATA

• The Seller is the data controller for personal data provided by the Buyer.

• Data is processed for order fulfillment and legal compliance.

• The Buyer has the right to access, correct, delete, or transfer their data.

• Full details on data processing are available in the Privacy Policy.

§ 11 RESERVATIONS

• It is prohibited to provide unlawful content.

• Each order is treated as a separate contract.

• Contracts are concluded in Polish or English.

• In case of disputes, the competent court is the Seller’s registered office court.
